Privacy notice
This notice explains what personal data we process when you use this site or contact us, why we use it, who we share it with and how to exercise your rights, under Mexico’s Federal Law on the Protection of Personal Data Held by Private Parties.

1. Who the controller is
Márquez Realty Group (trade name), with its address at Edificio Mapfre, Of. 303, Dr. Atl 1, Zona Urbana Río, 22010 Tijuana, B.C., México, is the controller of your personal data ("we" or "us").

2. What data we process
- Identification and contact details: name, phone number, email, country, language and how you prefer to be contacted.
- What you tell us about the property you want to buy, sell or rent: type, area, features, timing and your message.
- Browsing and campaign data: pages visited, landing page and referring site, campaign parameters (such as utm_source) and ad click identifiers, time zone, browser language and your cookie choice. Cookies are described in our cookie policy.
- Data needed for a transaction, only if you go on to buy, sell or rent with us: official ID, proof of address, tax details, marital status and the information the law requires us to collect to identify our clients. This is never requested through the site’s forms.
We do not process sensitive personal data, and our forms do not ask for financial or asset information (budget, income or credit). If you choose to share it another way, we will ask for your express consent.
3. Why we use your data
Purposes needed to serve you
- Answering your request and contacting you through the channel you chose.
- Scheduling property tours, in person or by video.
- Following up as your real estate broker: presenting options, negotiating, preparing contracts and coordinating with notaries, trust banks and other parties to the transaction.
- Meeting legal obligations, including client identification and record-keeping under Mexico’s anti-money-laundering law and tax and commercial laws.
- Protecting the site and preventing fraud and abuse of our forms.
- Handling complaints and rights requests.
Additional purposes you can refuse
- Sending you information about other properties and updates by WhatsApp, email and phone, only if you tick the box in the form.
- Measuring how the site is used, in aggregate (analytics).
- Measuring our ads’ effectiveness and showing you related advertising on Google, Meta (Facebook and Instagram) and TikTok, using cookies, pixels and contact details sent to those platforms in hashed form (SHA-256).
- Prioritizing the requests we receive with the help of automated tools, including artificial intelligence, so we can answer urgent ones first.
How to refuse: leave the messages box unticked; adjust your cookie settings; tick, when shown, the box “Do not use my contact details to measure advertising”; reply STOP or BAJA to any WhatsApp message or use the unsubscribe link in any email; or write to privacidad@marquezrealtygroup.com. Mexican phone numbers can also be registered in PROFECO’s do-not-call registry (REPEP). Refusing these purposes does not affect how we serve you.
4. Automated decisions
We use automated tools, including artificial intelligence, to sort and prioritize requests and to translate property descriptions. A person on our team handles every request: we do not make decisions with legal or similarly significant effects on you based solely on automated processing. You can object to this processing through the channels in section 8.
5. Cookies and similar technologies
This site uses its own cookies and local storage (needed to remember your cookie choice, your currency preference and where your visit came from) and, depending on your choice and region, analytics and advertising cookies and pixels from Google, Meta and TikTok. In the European Economic Area, the United Kingdom, Switzerland and Québec, no analytics or advertising tag loads until you allow it. We honor the Global Privacy Control signal as an opt-out of advertising. Details are in our cookie policy.
6. Who helps us process your data
Some providers process data on our behalf, only to provide their service to us. Several are outside Mexico, mainly in the United States:
- Netlify (website hosting).
- Neon (database).
- Cloudinary (image storage and delivery).
- EasyBroker (property listing platform).
- Google (Gemini artificial intelligence, analytics, maps and ad measurement, depending on your choice).
- Meta (WhatsApp Business for messages, and ad measurement depending on your choice).
- TikTok (ad measurement, depending on your choice).
- Our email provider.
7. Who we share your data with
Without your consent
- Notaries, trust banks, Mexico’s Ministry of Foreign Affairs and, where relevant, the other party, when needed for the transaction you ask us to handle (article 36 of the law).
- Competent authorities that require it by law, including Mexico’s Ministry of Finance and its Financial Intelligence Unit under the anti-money-laundering law, and courts.
Only with your consent
- Advertising platforms (Google, Meta and TikTok) when they act on their own account: only if you accept advertising cookies or, in regions where they load by default, as long as you do not reject them or tick the form’s opt-out box.
- Other brokerages we co-broker a transaction with: we do not share your data with them; if it ever became necessary, we would ask for your express consent first.
8. Your rights and how to withdraw consent
You can access, correct or delete your data, object to its processing (known in Mexico as ARCO rights), and withdraw your consent. Send your request to privacidad@marquezrealtygroup.com with:
- Your name and a way to reply to you.
- A copy of your official ID or, if you act for someone else, proof of your authority.
- A clear description of the data and the right you want to exercise and, where relevant, supporting documents.
We will reply within 20 business days and, if your request is granted, carry it out within the following 15 business days; each period can be extended once by the same length if the case justifies it. Exercising these rights is free; only reproduction or shipping costs may be charged.
9. How long we keep your data
- Contact and follow-up data, for as long as the relationship lasts and afterwards for the time needed to meet any resulting responsibilities.
- Client information that anti-money-laundering, commercial and tax laws require us to keep, for up to 10 years.
- Your cookie choices, 13 months; records of WhatsApp or phone clicks, 120 days; ad click identifiers linked to a request, 120 days; measurement events sent to advertising platforms, 30 days.
10. Security
We apply administrative, technical and physical measures to protect your data, such as encrypted connections, access limited to staff who need it, and providers with security controls. If a breach significantly affected your rights, we would inform you immediately.
11. Changes to this notice
We will publish any change on this page, with the date of the version in force at the top. If a change is relevant to you, we will also let you know through the contact details you gave us.
12. Authority
If you believe your right to data protection has been violated, you may contact Mexico’s Secretaría Anticorrupción y Buen Gobierno, the authority for personal data held by private parties.
13. If you are in the EU, the EEA or the UK
Where the General Data Protection Regulation (GDPR) or its UK equivalent applies, we rely on these legal bases: steps taken at your request before a contract and performance of a contract (answering and following up on your request); our legitimate interests (site security and fraud prevention); your consent (marketing messages, analytics and advertising), which you can withdraw at any time; and legal obligations.
You have the rights of access, rectification, erasure, restriction, portability and objection, and the right to withdraw consent, by writing to privacidad@marquezrealtygroup.com. You may also lodge a complaint with your country’s supervisory authority, such as the CNIL in France or the ICO in the United Kingdom. Your data is processed in Mexico and the United States; transfers are based on your request for our services and on our providers’ contractual safeguards.
14. If you live in Québec
You can write to the person in charge of the protection of personal information at privacidad@marquezrealtygroup.com. In Québec, by default, we do not load tracking technologies for analytics or advertising until you accept them. Your information is communicated outside Québec, to Mexico and the United States, for the purposes described in this notice.
15. Recipients in Canada
Under Canada’s anti-spam legislation (CASL), we send commercial electronic messages only with your express consent; every message identifies us, includes our contact details and lets you unsubscribe, and we process unsubscribe requests within 10 business days.
